Right to Information Act

This is the category page of the Right To Information Act, 2005 in India. The RTI Act was enacted to empower Indian citizens to access information from public authorities, foster transparency and hold the Government accountable to its constituents. As per Article 19 (1) of the Constitution of India, the right to information is a fundamental right. The right to information was made a fundamental right in 1976 by the Hon’ble Supreme Court in the landmark judgement of the “Raj Narain vs the State of Uttar Pradesh” case.

The Right To Information Act, 2005 came into force on October 12, 2005, that provides machinery to exercise this fundamental right. The RTI Act aims to encourage transparency, accountability and participation in the functioning of public authorities. Under the RTI Act, such institutions are called the public authorities which have been established by the Parliament or the State legislatures with the help of power given through the Constitution such as government-funded NGOs.

As per the RTI Act, all Indian citizens hold the right to request information from the government authorities. This information can pertain to government decisions, policies, matters of public interest, etc. Some types of information are exempted from being requested such as internal security, intellectual property rights, etc. The Public Information Officers are those who can give information to any person on his request. As per the RTI Act, any private institution that is funded by the government or the institution that has a public-private partnership comes under the ambit of the RTI Act indirectly.
