In this post, I am going to tell you what Second Appeal in RTI is, and how to file a second Appeal.

What is the Second Appeal?
As per Section 19 of the Right to Information Act, there are two stages of RTI appeal. If a person is dissatisfied with the decision of the First appellate authority or he does not get any reply within 30 days of filing the first appeal, he can file the second appeal before the Central Information Commission or State Information Commission.
Where to file the second appeal?
The second appeal in RTI can be filed either in Central Information Commission or State Information Commission, depending on where you have filed the RTI firstly.
If you have filed the RTI in any office under the Central government then you have to file the second appeal in the Central information commission and if you have filed it in an office under the State government then in State Information Commission.
When can you approach CIC or SIC?
There are certain steps to approach Central Information Commission or State Information Commission, the applicant cannot approach the CIC or SIC directly. He has to go through the following process:
- Firstly, you need to file an RTI application. And the officer who provides the information is called the Public Information Officer(PIO). The PIO is bound to provide the information within 30 days.
- If the PIO fails to provide the information within 30 days or the applicant is dissatisfied with the decision of the PIO, he can file the FIRST APPEAL before the First Appellate Authority.
- If the applicant does not get the information within 30 days of filing the First appeal or he is dissatisfied with the decision, he can file the SECOND APPEAL before Central Information Commission or State Information Commission.
Time limit to file the Second appeal in RTI?
After filing the First appeal, three months( 90 days ) are given to file the Second appeal.
If you file beyond the time limit of three months, CIC or SIC can reject the application. In rare cases, the application can be given to condone the delay and if CIC or SIC finds a reasonable reason, it can accept the Second appeal application.
Format To file the Second appeal:
- Address of Chief information commissioner
- Subject: Second appeal under RTI
- Name and address of the appellant
- Name, designation and address of the Public Information Officer
- Name, designation and address of the first appellate authority.
- Mention the reasons to file the second appeal in RTI.
- Mention the chronology of all the events.
- Your address and the necessary contact information
- At last, you can add an Index mentioning all the documents that you have annexed with the application.
How to file a Second appeal in RTI? (Online)
- Firstly, log in to https://cic.gov.in/, the website of CIC.
- Scroll down and click on CITIZEN SERVICE
- Choose SUBMIT ONLINE APPEAL AND COMPLAINT
- Fill in all the asked details
- The second appeal should be either in ENGLISH or HINDI, but if it is in some other language then it is mandatory to attach a translated version in Hindi or English.
- Attach every required document in pdf form and your one id proof
- Click on declaration and submit your application
- A unique diary number will be generated, which you can use for future reference.
Where to file a Second appeal? (ONLINE)
- Firstly, log in to https://cic.gov.in/, the website of CIC.
- If you want to file a second appeal in an office under the State government, click on USEFUL LINKS and choose State information Commission. A list will appear and you can choose the particular state commission.
- The official website for the information commission of that state will appear on the screen
- It will be beneficial if the application is written in English or the local language of that particular state.
How to file a Second appeal in RTI? (OFFLINE)
- Write down the application as per the format
- Attach all the necessary documents
- The documents must be self-attested
- YOU can send it by post to the CIC

- Speed post copy or Reiieving copy or Reply from PIO
- First appeal
- Speed post copy or Reiieving copy or Reply from the first appellate authority
- Any other supporting document
