As the world of the internet is anonymous, there are possibilities of engaging in various criminal activities in cyberspace. This led to the need for Cyberlaws in India. A cybercrime is an unlawful act in which the computer is either a tool or a target or both. Cyber crimes needed to be addressed specifically and that’s when the Information Technology Act, 2000 (IT Act) was enacted. The IT Act is the cornerstone cyber law of India.
The IT Act addresses an extensive range of issues which includes digital signatures, electronic governance, data protection and cyber crimes. Just like IPC, it defines various cyber offences such as hacking, data theft, etc. and prescribes penalties for such cyber crimes. The increasing digitalisation of personal information brought the need for data protection and privacy. The Digital Personal Data Protection Act, 2023 regulates the processing of personal data and establishes a framework to protect the privacy of individuals. This act addresses accountability, transparency, data minimisation, lawful processing of data, etc.
The National Cyber Security Policy 2013 was formulated to enhance cybersecurity measures. It lays down the measures to protect information infrastructure, prevent cyber threats and strengthen cybersecurity capabilities. Cyber laws in India depict the commitment to address the challenges posed by the digital era.
