Since India is a diverse country which has people following different religions. Therefore, there is no uniform code for family laws but different family laws based on religion.
The family laws in India find their ethos in the legal framework surrounding marriage. Different laws such as The Hindu Marriage Act, 1955, the Muslim Personal laws and the Special Marriage Act lay down principles on marriages among Hindus, Muslims and people of different religions. These Acts outline the conditions of a valid marriage, what makes it invalid and the provisions of divorce. These laws specify what can be the ground of divorce which are different in different personal laws.
The welfare of children in cases of divorce and separation has been given priority by family laws in India. The Guardians and Wards Act, 1890 and the Hindu Minority and Guardianship Act, 1956 govern matters related to child custody in India. The Maintenace laws ensure financial support for children, parents and spouses. The Hindu Adoption and Maintenance Act, 1956 lays down the principles for adoption for Indian Hindus. The Hindu Succession Act, of 2005 governs the distribution of property among Hindus, while Muslims follow the principles of Islamic law. The Protection of Women from Domestic Violence Act, 2005 addresses the issue of domestic violence in India. The Dowry Prohibition Act, 1961 was enacted to curb social evils like dowry harassment.
